Net-Conception supplies a range of web-site design, hosting and search engine optimization services provided under the Terms and Conditions set out hereunder. By using our services you are accepting these terms and conditions which do not affect your rights and obligations under the consumer protection laws currently in force.Client login area
Your client log-in is for your personal use only. You must not divulge the password to any other person and you should take reasonable precautions to ensure that it is not discovered by other people.
Web-site design
All websites are designed to be compatible with Internet Explorer 5 and above, websites are also compatible with Netscape and Opera, however some features may not always be supported by these browsers. All websites are optimised for viewing at a 1024 x 768 resolution but shall be usable at resolutions from 800 x 600 and upwards.
We provide a search engine optimisation service for any client utilising our bespoke design service. Net-Conception makes no guarantees of ongoing performance of our client websites and cannot be held responsible for any drop in traffic or search engine ranking.
Content
Net-Conception will not be held liable for any claims made in regard of the website′s content. You agree that the content provided by you for your website either directly or via Net-Conception will not in any way be unlawful, misleading, abusive, offensive, prejudicial or be likely to expose us to claims, lead us into prosecution, criticism, disrepute or cause us embarrassment. You are responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your pages.
We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.
We do not allow adult content or software / media piracy on our servers.
Hosting
We have links with major hosting providers who promise 99.9% uptime. However, no guarantee of service can be made by Net-Conception on behalf of the host. Net-Conception will remain your point of contact for any issues you have with the service and will do everything in its power to resolve problems as swiftly and as professionally as possible. Net-Conception will not be held liable for any loss of turnover, sales, revenue, profits or indirect or consequential losses associated with the website hosting.
Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your website. We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. You may not exceed your allotted disk space allocation.
Any form of un-solicited bulk e-mailing or spam is not allowed.
Each web-site includes a nominated amount of bandwidth. If you use more than this amount then you agree to pay for this bandwidth at a rate of 5p (five pence) per 1 MB. If your bandwidth reaches the point where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.
Hosting must be paid for annually in advance.
Domain names
Net-Conception offer a domain registration service subject to the Nominet′s terms and conditions. Prices include an administration charge for carrying out the registration. The domain name will be registered in your name and/or business name through a third party company as selected by us. If you choose Net-Conception to carry out the registration, administration rights of the domain name should remain with us whilst legal ownership remains with you. A reminder will be sent to you by Net-Conception via e-mail approximately 6 weeks before the domain name is due to expire. Late re-registration of a domain name can result in a £220 charge or - if too late - its expiry. You accept that Net-Conception will not be held responsible for a missed registration of any domain name.
Links
Net-Conception may provide links to other websites. Net-Conception has no control over such websites and resources, and you acknowledge and agree that Net-Conception is not responsible for the availability of such external websites, does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Net-Conception shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content.
IPR
You agree that you own the intellectual property rights of any content provided to Net-Conception, or that the owner has given you permission to use the content and will allow Net-Conception to use it on your behalf. On contract completion and on receipt of full payment, the copyright of all bespoke web authoring or graphics will be handed over to the client. However, you agree that Net-Conception may use images of and links to your web-site for purposes of promoting its business. Net-Conception will retain the copyright of any stock photography, templates, components or library code used in the creation of your site. If provided, any database query strings along with any ASP.NET and PHP files will also remain the property of Net-Conception and/or its sub contractors. You agree not to reproduce, duplicate, copy, sell or resell any portion of the services or products provided by us. Website files can be provided via e-mail, or on CD-R for an additional fee.
Virus protection
Whilst we carry out regular virus checks on our systems and virus check every incoming and outgoing file, we make no warranties that files sent from Net-Conception are free from virus infection and recommend you virus check all files received from us prior to opening or executing.
Search engine optimization
Net-Conception make no claims about search engine rankings for a website following search engine optimization and will not be held liable for any loss of turnover, sales, revenue, profits or indirect or consequential losses associated with the website in general and the website′s search engine rankings in particular.
Privacy
We are committed to safeguarding your privacy while providing the highest possible quality of service. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). If you have any requests concerning your personal information or any queries with regard to these practices please contact us.
We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. We collect the information you supply to us through enquiry and registration forms, and every time you e-mail us. We will never collect sensitive information about you in any other way without your explicit consent.
To protect your privacy we never distribute your name, e-mail address or other particulars to any third parties.
Quotations
Any quotation given for website design and/or hosting will be valid for a period of 30 days from the date of submission. A non-refundable 30% deposit will become due on acceptance of our quotation and shall be paid before any work commences. The remaining 70% will become due on completion of your website.
Where requirements change so as to exceed those cited in the original quotation, Net-Conception reserves the right to request additional payment before undertaking work related to the altered requirements.
Invoicing
Invoices will be sent via e-mail (unless otherwise requested) in PDF format. Payment is due within thirty days from the date of invoice and a finance charge will be due on the unpaid balance at the rate of 2% per month which is an annual percentage rate of 24%. This charge will be computed by applying the daily rate of 0.657% to the daily past due balance for the number of days from the invoice payment date. Payment may be made by cheque or Internet transfer.
Refunds
You may cancel your order within 7 days from when the contract is concluded, without giving a reason. If you exercise your right to cancel, we will then return your money within 7 days of cancellation.
If you cancel your account within your service period then we will not make any refunds on any unused portions of your account, other than cancellation within the guarantee period when a full refund will be made.
Mistakes and complaints
We will correct any mistakes in bills, receipts or payments as soon as possible, and at the latest within 30 days of agreeing to do so.
